The purpose of this report is to argue a possible explanation for scarce argumentation in Russian court decisions, limited to the sphere of private law. The author believes that the difference in style of Western European and Russian decision cannot be explained only on the basis of codification and its influence on rational decision making. In answering this issue, national legal consciousness should be taken into account.
